The goal of the Edgewoodtestvets.org Web site (“this Site”) is to provide information about (1) litigation brought on behalf of Vietnam Veterans of America and certain U.S. military veterans involving the chemical and biological testing of U.S. military personnel that primarily took place at Edgewood Arsenal, in Maryland, during the 1950s to 1970s (the “Edgewood Test Vets Litigation”), including the lawsuit Vietnam Veterans of America v. CIA (click here for more information about this case), and (2) resources available to veterans who may have served at Edgewood Arsenal or been subjected to other chemical or biological tests. In addition, if you are a veteran who participated in the testing done at Edgewood Arsenal (and you are currently residing in the United States), this Site provides you an opportunity to fill out a questionnaire if you wish to be contacted about your service.

This Site is organized and maintained at the direction of Morrison & Foerster LLP (“Morrison & Foerster,” “we,” or “us”), counsel for the plaintiffs in the Edgewood Test Vets Litigation. This Privacy Policy explains our practices in connection with information that we collect through this Site. This Policy does not address our practices regarding information received through any website, or by any other means, other than through this Site.

By using this Site, you agree to the terms and conditions of this Policy. If you do not agree to the terms and conditions of this Policy, please do not use the Site. We reserve the right to modify this Policy at any time. You can determine when this Policy was last revised by referring to the “Last Updated” legend at the top of this page. What Information About Visitors Does This Site Gather?

  • Information That You Provide: If you are a veteran who participated in the testing done at Edgewood Arsenal, and if you are currently residing in the United States, this Site gives you the chance to fill out a questionnaire about your experience. This questionnaire requests certain personally-identifiable information, such as your name, telephone number, military service, and other information. Your decision to provide any information requested in the questionnaire is entirely voluntary.

Before you submit information through this Site, you should be comfortable: (1) with that information being used and disclosed in the Edgewood Test Vets Litigation, as described below, and (2) with possibly being contacted by Morrison & Foerster or related parties regarding the information you provide.

This Site is not directed to children under thirteen (13) years of age, and Morrison & Foerster does not knowingly collect personally identifiable information from such children. If you are younger than thirteen, please do not provide any personally identifiable information while using this Site.

  • Information That We Receive Automatically: This Site may automatically collect certain information whenever you visit this Site, including the date and time of your visit, the URL you visited prior to visiting this Site, the numerical Internet Protocol (IP) address of the computer you are using, the Internet Service Provider you are using to connect to the Internet, the kind of browser you are using and the version of that browser, or the type of computer operating system you are using. This information is logged, but Morrison & Foerster does not use it for any purpose other than to analyze Site traffic patterns and to identify and correct problems on this Site.
  • Cookies and Other Related Technologies: This Site does not use cookies or pixel tags or other similar data collection technologies.

How Does Morrison & Foerster Use Information Collected Through This Site?

Any information collected through this Site, including personally-identifiable information, may be used in connection with the Edgewood Test Vets Litigation. For instance, Morrison & Foerster may use this information for the following purposes: investigating factual matters related to the Edgewood Test Vets Litigation; developing legal theories and case strategy; drafting and responding to motions and other legal proceedings; and assessing potential methods of case resolution.

How is Personally-Identifiable Information Disclosed?

Morrison & Foerster may share information collected through this Site, including personally-identifiable information received through questionnaires, with its clients in the Edgewood Test Vets Litigation. In certain cases, Morrison & Foerster also may determine it is necessary to make some of this information available to the defendants in the Edgewood Test Vets Litigation and their legal counsel, in order to comply with legal obligations or to represent the plaintiffs’ interests in the Edgewood Test Vets Litigation. Additionally, to the extent any of this information needs to be filed with the court or disclosed in courtroom proceedings, it may become publicly available in court records, although Morrison & Foerster will take any measures it believes are necessary or appropriate to protect personally identifiable information collected through this Site from disclosure to the general public. Morrison & Foerster also may be compelled by law to provide information that you have submitted through this Site, and we will comply with those obligations.

Morrison & Foerster works with third parties who provide web hosting services and other services of an administrative nature. We may share information about you with such third parties for the purpose of enabling them to provide these services.

Notwithstanding any provision of this Policy to the contrary, Morrison & Foerster reserves the right to use and/or disclose information about you if we believe that we are required to do so for any or all of the following reasons: (1) by law; (2) to comply with legal process or governmental requests; (3) to prevent, investigate, detect, or prosecute criminal offenses or attacks on the technical integrity of the Site or our network; (4) to enforce our Terms of Use; and/or (5) to protect the rights, privacy, property, business or safety of Morrison & Foerster and its affiliates, their partners, and employees, the users of the Site, or the public.

Morrison & Foerster reserves the right to disclose or transfer any and all information that we collect in connection with this Site to any third-party law firm or lawyer retained as plaintiffs’ counsel in the Edgewood Test Vets Litigation, as well as to any consultant or expert retained by plaintiffs’ counsel in the Edgewood Test Vets Litigation.
